# End User Licence Agreement — Quotidia

This agreement governs use of the **application**. It is separate from
`LICENSE`, which governs the **source code** and grants nobody
any rights. Where a store imposes its own end user terms, those apply in
addition to these; where they conflict, the store's terms prevail for
installations obtained through that store.

## 1. Licence granted

The Licensor grants you a personal, non-exclusive, non-transferable, revocable
licence to install and use Quotidia on devices you own or control, for your own
purposes.

The application is licensed, not sold. You acquire no ownership in it.

The licence is granted free of charge. It is perpetual, requires no renewal,
and carries no fees.

**Voluntary contributions.** The application may offer a way to support the
project. Any contribution you choose to make is voluntary and does not change
this licence: it does not buy the application, a feature, content or any
right, and it grants no entitlement to support, updates or any other service.

By installing or using the application you confirm that you are at least 13
years old.

## 2. Restrictions

You may not:

- copy, distribute, sublicense, rent, lease, lend, or sell the application, or
  make it available to others over a network;
- reverse engineer, decompile, or disassemble the application, or attempt to
  derive its source code, except to the extent that applicable law expressly
  permits despite this restriction;
- modify the application, or create derivative works from it;
- remove, obscure, or alter any copyright, trademark, or other proprietary
  notice;
- use the application to build a competing product, or use its name or branding
  without written permission.

Nothing in this clause limits rights granted to you by Article 6 of Directive
2009/24/EC on the legal protection of computer programs, or by the national law
implementing it, concerning interoperability.

## 3. Intellectual property

The application, its source code, design, branding, and name remain the
exclusive property of the Licensor and are protected by copyright and, where
registered, trademark law. This agreement transfers no intellectual property
rights.

## 4. Your data

Quotidia stores your content on your device and transmits nothing to the
Licensor. When you switch on synchronization, Quotidia copies your content to a
private folder in your own Google Drive so your other devices can read it.
Google processes that copy under its own privacy policy; the Licensor is not a
party to that transfer. See the **Privacy Policy**.

**You are responsible for your own backups.** The application provides an export
function. The Licensor holds no copy of your data and cannot recover it if your
device is lost, damaged, reset, or if the application is uninstalled.

## 5. Availability, support, and updates

The Licensor intends to keep the application available, supported, and
updated. This statement of intent is not a contractual commitment. The Licensor
may release updates, change or remove features, or discontinue the application
at any time. No particular feature, update, level of support, or period of
availability is guaranteed, and no liability arises from the application, an
update, or support ceasing to be available.

## 6. Warranty

The application is provided "as is" and "as available", without warranty of any
kind beyond what applicable law requires.

**Consumers in the European Union**: this clause does not affect your statutory
rights, including the conformity guarantee under Directive (EU) 2019/770 on
contracts for the supply of digital content and digital services, and, in Spain,
under the Real Decreto Legislativo 1/2007 (TRLGDCU). Those rights apply
regardless of anything stated here.

**Supply in a single act.** The application is supplied to you in a single act,
free of charge. In accordance with Article 120.1 of the
Real Decreto Legislativo 1/2007 (TRLGDCU), the Licensor is only responsible for
lack of conformity that existed at the moment of supply and appears within two
years, and does not contractually undertake to supply updates.

## 7. Liability

To the maximum extent permitted by applicable law, the Licensor is not liable
for indirect, incidental, special, or consequential damages, or for loss of data
or profits, arising from use of the application.

Nothing in this agreement excludes or limits liability for death or personal
injury caused by negligence, for fraud or fraudulent misrepresentation, or for
any liability that applicable law does not allow to be excluded. Consumer rights
that cannot be waived are unaffected.

**Reminders and alarms.** Quotidia schedules notifications through the operating
system. Delivery depends on the device, its power management, manufacturer
software, and the permissions granted. The application cannot guarantee that any
reminder or alarm will be delivered, and must not be relied upon where a missed
notification would cause harm — including medication, medical appointments, or
any safety-critical purpose.

## 8. Termination

This licence ends automatically if you breach it, and you may end it at any time
by uninstalling the application. Sections 3, 6, 7, and 9 survive termination.

## 9. Governing law

This agreement is governed by the laws of Spain. Consumers keep the protection
of the mandatory provisions of the law of their country of residence, and may
bring proceedings in the courts of that country.

## 10. Changes

The Licensor may amend this agreement. Material changes will be notified through
the store listing or the application, and continued use after they take effect
constitutes acceptance. If you do not accept them, stop using the application
and uninstall it.
